Exactly.

Phil, you don't understand.  It has nothing to do with whether he was
impaired.  I don't care what the story is.  Short of visiting your dying
grandmother, the bottom line is that good things simply don't happen at 3:30
AM.  Not ever.  As David Haugh said, just the fact that you would be doing
anything on the road at that time of the morning is not good.

I don't care what he was doing.  I don't care what his blood alcohol was.  I
don't care if he was just high on life.  To me it's irrelevant.  Just being
there was, at minimum, poor judgment and probably poor self control.
