You started using big words and ya lost me. :-)

If I'm understanding you correctly, you want to separate athletics - for all
intent and purposes - from the institutions of higher learning.  And you're
right; nobody would go for it.

Why?  It could happen through mutual consent of the member schools of the
NCAA.  That is why it won't happen, not because of Congress or the courts.
The member schools would probably not agree--all of them across the
board--to such a move.  While I would argue it is in their best interests to
get athletes out of the classroom and to set up their sporting programs as
pure money-making ventures, I could imagine a lot of resistance from
traditionalists, who idealize the vision of the "student-athlete."  It's the
pragmatics of my proposal where it would founder, not on its legality, as
far as I can tell.
