Some area's of observation. Just a couple. Most likely not the place for this.
1. Only crime your not allowed to speak to a lawyer first. If you refuse to cooperate with out an attorney, you get punsihed. Its called the dui exception to the constitution. 1984 Berkemer vs McCarty.
2. Only crime where eveidence(breathilizer), does not have to be saved by the state. It can be saved, but has proved to be to costly(4.50 each). State and federal courts have backed this up. Not only is the evidence not saved, its destroyed. This is called the Trombetta exception to the constitution. 1984 Trombeta v California.
3. The breatilizer itself. Its concept works on the idea that everyone is average. The average person on this earth is a Chineese female with one child.
4. The only crime police may pull you over for no reason. They can use roadblocks, or they can just pull you over under suspision of a dui, and force you to take the breathilizer. This is called the Stitz exception to the 4th amendment. 1990 Stiz v Michigan.

    But I will say that the US Goverment following the lead from state governments has allowed its laws about DUI's to become uncontitutional. Unfortuneately for Benson.
